1060.01   LIMITATIONS ON CONTAINERS; EXCLUDED ITEMS

Garbage and refuse is hereby described as any household garbage or refuse which can be contained in a thirty-gallon trash bag or equivalent capacity container.  Other containers (outside of this description) filled with garbage or other materials which would otherwise exceed the four bag/container limitation will be considered exclusionary.  Other excluded items are automobile tires, appliances, furniture, building materials, and any hazardous waste material.

1060.02   FEE; PAYMENT

(a)        There is hereby imposed a garbage and refuse collection fee of thirty-two dollars ($32.00) per quarter for each dwelling unit in the Township.  The aforesaid collection fee shall be assessed for the collection of no more than four bags of garbage per week per dwelling unit.  Amendments to the collection rate and/or limitation on quantity or nature of materials collected may be made by resolution of the Board of Commissioners.

(b)       Collection of the garbage and refuse collection fee shall be by the Township of Lawrence Park on the sewer rental/usage statement, payable at the office of the Township Treasurer.  Collection shall be on a quarterly basis.  No rebates or credits shall be given for vacant dwelling units.

(c)        Payment shall be made within thirty days from the date of billing.  A second or final bill will be sent and failure to make payment within thirty days of such bill will result in the real property being liened or in other appropriate legal action being taken.  In addition, a penalty of 1.25 percent will be added each month if such bills are not paid on or before the due date.

(d)       The person responsible for making payment of the garbage and refuse collection fee shall be the owner of record.

 (e)        As an alternative to the collection of garbage and refuse by the Township, the Board, pursuant to competitive bidding, may designate an authorized garbage and refuse collector and approved fee schedule.  Payment of fees pursuant to this alternative shall be made directly to the approved collector and shall be in lieu of the fees established in this Section.

1060.025   COLLECTION FEES FOR DELINQUENT ACCOUNTS

(a)        In addition to any charges imposed by the Township for the collection of garbage, there shall be added any additional costs and/or reasonable attorney fees incurred by the Township for the collection thereof.  The same shall be added to the unpaid amount and the aggregate may be entered as a lien on the property served and collected in accordance with the provisions of the Municipal Claims Act, as amended.

(b)       The schedule for the collection of delinquent garbage charges shall be as follows:

(c)        Additional work not specifically listed above shall be billed on an hourly basis.  The hourly rate shall be the applicable rate as agreed upon and billed to the Township by the Solicitor, said rate being sixty-five dollars ($65.00) at the time of the adoption of this section.

1060.03   UNLAWFUL DEPOSITS BY NONRESIDENTS

(a)        The depositing by nonresidents of the Township of garbage, trash and rubbish anywhere within the Township for the purposes of causing the same to be collected and carried away by the Township is prohibited.

(b)       It is hereby made unlawful for any resident of the Township to permit the depositing upon his or her property of garbage, trash and rubbish by nonresidents of the Township for the purpose of causing the same to be collected and carried away by the Township.

1060.04   SETTING OUT OF GARBAGE, RUBBISH AND RECYCLABLES

Garbage, rubbish, and recyclables shall not be placed out for collection earlier than 3:00 p.m. on the day prior to the scheduled pick-up date of said items, and must be put out in a solid, animal proof container with a lid.  All containers shall be removed from the area not later than 12:00 midnight on the date of collection.

1060.99   PENALTY

Any person who shall be found guilty of violating any of the provisions of Section 1060.03 or 1060.04 in a suit brought before a District Justice shall pay a fine or penalty of not less than twenty-five dollars ($25.00) and not more than three hundred dollars ($300.00).
